On this morning's edition of Morning Joe, the panel took on the leaked document showing how the Obama administration justifies its expanded executive authority to assassinate an American citizen abroad through drone strikes. Host Joe Scarborough clashed a bit with other panelists as he felt the entire ordeal is a "frightening" development in Obama's administration.

"Here you have something truly chilling," Scarborough said of the drone news. "Here you have the United States government saying, we can kill you, American citizen. You have no constitutional right to a jury by your peers. You have no constitutional right even to probable cause or to due process. You have no right to a lawyer. You have no right to counsel. You have no right to anything. If we suspect you, just suspect you, without evidence, that you were thinking about committing an act against the United States of America, we can kill you."

The ACLU, now after the fact..... Is filing an injunction against this practice...

The courts have a crucial role to play in determining the lawfulness of U.S. drone killings of three American citizens in Yemen in 2011, the ACLU and the Center for Constitutional Rights argued in a brief filed last night in a lawsuit challenging the killings (you can read the brief here).

Our lawsuit charges that U.S. citizens Anwar Al-Aulaqi, Samir Khan, and 16-year-old Abdulrahman Al-Aulaqi were killed in violation of the Constitution's fundamental guarantee against the deprivation of life without due process of law. In December, the government filed a motion to dismiss the case, arguing, in essence, that the courts should not be involved in determining the lawfulness of the targeted killing of U.S. citizens.
