Good for Judge Billings who understands the rights of the people!!
A New York judge issued a temporary restraining order allowing protesters to return to Zuccotti Park only hours after police forcibly removed them, arresting dozens. The order by Justice Lucy Billings set a hearing date for Tuesday at 11:30 a.m. and said that until the matter was considered at that hearing, the city and Brookfield Properties, the owners of Zuccotti Park, would be prohibited from evicting protesters or "enforcing 'rules' published after the occupation began or otherwise preventing protesters from re-entering the park with tents and other property previously utilized." Police are restricted from removing tents and or property of the protesters. I think this is big and will set a tone for the rest of the country. This movement isn't going away..deal with it!!! |

Because Zuccotti Park is not a publicly owned space, it is not subject to ordinary public park curfew. New York City Police Commissioner Raymond Kelly said on September 28, 2011, that the NYPD could not bar protesters from Zuccotti Park since it is a public plaza that is required to stay open 24 hours a day. "In building this plaza, there was an agreement it be open 24 hours a day," Kelly said. "The owners have put out regulations [about what's allowed in park]. The owners will have to come in and direct people not to do certain things." So the ruling is valid under that agreement with the city! |

Dear Commissioner Kelly: As you know, for over three weeks, Zuccotti Park (the “Park”) has been used by “Occupy Wall Street” and other protesters as their home base. The Park is owned by a Brookfield affiliate and was recently renovated at Brookfield’s considerable expense as an amenity for the general public. It is intended to be a relaxing tree-filled oasis in the midst of the hustle and bustle of Lower Manhattan. We fully support the rights of free speech and assembly, but the manner in which the protesters are occupying the Park violates the law, violates the rules of the Park, deprives the community of its rights of quiet enjoyment to the Park, and creates health and public safety issues that need to be addressed immediately. Within the Park, the protesters have set up living spaces with tarpaulins, mattresses, sleeping bags, tables, bookshelves, gasoline-powered generators and other items that arc inconsistent with the rules and normal public use of the Park. For all of these reasons, we cannot currendy ensure that the Park is safe nor can we perform the necessary cleaning, inspection, damage assessment and repairs. In light of this and the ongoing trespassing of the protesters, we are again requesting the assistance of the New York City Police Department to help clear the Park so that we can undertake this work at the earliest possible time. Protesters weren’t the only ones ‘occupying’ Zuccotti Park in lower Manhattan. It’s no surprise that after almost two months of communal living in a park with no bathrooms – the potential for bacteria and infection to run rampant finally caused city officials to step in.
So, I say kudos to the Bloomberg administration for finally breaking up the cesspool of garbage in Zuccotti Park. In the early hours of Wednesday morning, Mayor Bloomberg ordered the NYPD to move in and clear out the Occupy Wall Street camp. Shortly afterward, the sanitation department took over to clean the once-beautiful park that had been made filthy after months of occupation. Personally, I was waiting for a major health crisis to break out at any time. I’m certain that Zuccotti Park was on its way to becoming a source of serious health problems. Already, we have seen cases of pneumonia and tuberculosis crop up in other Occupy camps around the country. In fact, health officials recently reported that at least two people have contracted TB at a homeless shelter that has been housing “Occupy Atlanta” protesters. One was confirmed to have a particular TB strain that is resistant to a single, standard medication. With this news, and then after actually seeing what was going on in Zuccotti Park once the sanitation department got there, I began to wonder: Why did the clean-up take so long to happen? Among the 26 truckloads of trash, the sanitation department found spoiled foods, hypodermic needles and other drug paraphernalia and evidence of scabies and lice in the park – all of these factors amount to a major problem for any city. Potentially clinical conditions, such as community-acquired pneumonia and tuberculosis, could have not only affected the Wall Street occupiers, but also the millions of New Yorkers that use lower Manhattan as their workplace or home. The protesters have argued that their right to free speech has been trampled on by being forced out of the park. I’ve got to be honest – I don’t understand how free speech can give you the right to endanger the health of others.
