I have actually been in a situation when I was being verbally and sexually harrassed..I took the guy to court and won the case

When dealing with harrassment,u always need proof that it is occuring.
U need an actual log that keeps track of the situations taking place with date,time,witnesses
There should already be a policy in place at work,if not go by the city laws until one is in place or contact a corporate law firm on what should be in the policy

For a company policy, check with your local labor department and state and Federal OSHA regs. Policies for work need to be written and established according to the applicable Federal, State and Local Standards. They should then be provided to all employees, read and a confirmation signed by the employee and kept on file. The employer can be held legally responsible for Harassment at work if the company is not careful about implementing and strictly adhering to written policies. There are companies that specialize in providing policies that have been prepared and meet all requirements. (JJ. Keller, and BLS come to mind, off the top of my head). I was a Health and Safety, Compliance officer for 2 companies.

then you have to go with what can legally be done and this often let's the guilty go free

if it can't be proven - no witnesses, no emails, no recorded calls or left messages, and no admission than you probably can't find against them ala innocent til PROVEN (not assumed) guilty

but I'd encourage victims to file their claims anyway because they may not be alone in their issues with a perpetrator - in which case there could ultimately be a preponderance - enough complaints to make u say - "whoa this guy/gal is up to NOOOOOOO good"
