Along the lines of the other thread, but this one happened to me...

So after my divorce I stay with my dad at his house for a month or two until I get my own place again (of course changing my address for my mail both times). A few months later my brother comes back from living in Orlando and stays with him for about 4 months after I leave.

One day my dad is at work and my brother is home by himself. He was upstairs on the computer when he heard a knock at the door. Actually it wasn't so much as a knock as it was a fist pounding on it. He went down stairs and the pounding came again. He yelled "Alright I'm coming!" and opened the door. Immediately the person on the other side started to push it in so he instinctively thought "home invasion" and shoved back. The other person yelled "Open up, police!" so my brother stopped pushing and they rushed in. They roughly sat him down on the couch and began questioning him about me.

Officer: Do you know (my name)?!
My brother: Yeah, he isn't here.
Officer: Do you know where he is now?
My brother: No, probably at work.
Officer: Do you know he's wanted for murder in Atascosa county?
My brother: Umm...what?!

At this point they are ransacking the house and generally making a mess looking for me or any "clues" I may have left behind. Supposedly I killed a guy for some reason or another (he was probably snoring!). After they realize I'm not there they regroup and go over their paperwork. My brother is still talking to them and happens to glance at it and says "Ummm...you guys know you have the wrong address right?"

They stare at him for a sec before dismissing what he said, but radio back and double check. Sure enough the address wasn't even close, not to mention the guy they are looking for is 12 years older than I am :P They realize they have the wrong place AND the wrong guy (same name though) and call it off. My brother is outside and he sees the SWAT van and 4 police cars, then 6 guys come from the bushes and the backyard with sniper rifles. I can just imagine if I would have been there, I could have been arrested, beaten, or even shot. At least it would have given the neighbors something to talk about haha.

Oh, and my dad was super pissed when he got home (he's a neat freak).

Here it is, citizens! A public service announcement.

Do not trust the police. You are not obligated to trust them or to like them. Just follow the law as best you can, and learn more about some laws you are not aware of.

Never let the police into your home or step outside to talk to them. They always say they just want to talk to you or "ask you a few questions." This is a lie, they are there for one thing, to arrest you and take you away. You are protected under the 4th Ammendment. Do not say a WORD.

Always demand a warrant, and actually see and read this warrant before letting them in or allowing them to speak to you.

Do not tell them where someone you know is, you're under no obligation to do so under the 5th Ammendment.

Get an attorney now, even if you think you may never need one. It's added security to have one in your back pocket that you can call, in case you ever do need one.


Never fill out a statement or leave a deposition or verbal account without an attorney present, and even then do not offer anything without your attorney's best advice first. The police and the courts have the burden of proof, YOU do not. Miranda law.

I had a similar incident happen. Back in 1980, when I was married and expecting my first, around 4 am the doorbell rang and then they started the banging on the door. We were living in an apartment on the 2nd floor so it did take a few minutes to get to the door downstairs. My husband, at the time, went down and I looked out our front window where I saw about 6 cop cars, paddy wagon and a few unmarked cars, and then I ran to the back and saw about the same amout there with everyone having their guns out and pointed at the building. Thank God the 1st floor neighbor was also the owner because they didn't believe that the person they were looking for moved out about 6 months prior to us moving in. They did apologize and the lieutenant in charge came up to make sure I was ok, but this all could have been avoided if they just checked before the planning their seige. To this day, I do not know what they wanted this guy for but I did feel sorry for him, this was back when the Philly cops could beat the crap out of you and no questions were asked.
