You have a few days to file one, but I just don't want my insurance going up because of it. It is my understanding that the person who is the "rear ender" is ALWAYS at fault. i think new york is a no fault state but i am not sure bout that New York Insurance Law - No-Fault Links http://www.ins.state.ny.us/r68_link.htm |

those who hit a stationary vehicle are almost always at fault
unless it is extremely dark and the vehicle is in the roadway and improperly illuminated it is a thing called assured clear distance [i think] there i go agian |
