Okay all of you...what do you know about this?

It's 5a.m. and I don't feel like staying up.

I am not asking for related rants (now I am sure I will get them haha )just information specific to this kid and his story.

NC teen held under Patriot Act

Ashton Lundeby is more than 7oo miles away from his family.

The sixteen-year-old Oxford teen is in a juvenille facility in South Bend, Ind. on a criminal complaint that he made a bomb threat, according to WRAL-TV.

Armed federal agents with the assistance of local law enforcement raided his mother’s home Mar. 5 looking for Ashton. The Raleigh-based station reports the teen was handcuffed and then his mother was presented a search warrant.

Authorities claim the home-schooled teen made a bomb threat on the night of Feb. 15. But his mother, Annete Lundeby, says the family was at a church function that night. She believes someone hacked into her son’s IP address and made the threat.

She says agents ignored her claim and a warrants list the items siezed as a computer, cell phone, gaming cosole, routers, bank statements and school records.

“There were no bomb-making materials, not even a blasting cap, not even a wire,” Lundeby said.

WRAL reports that Lundeby has had limited access to her son since the arrest two months ago.

She says that her son has been denied due process by the Patriot Act.

We have no rights under the Patriot Act to even defend them, because the Patriot Act basically supersedes the Constitution,” she said. “It wasn’t intended to drag your barely 16-year-old, 120-pound son out in the middle of the night on a charge that we can’t even defend.”

Never in my worst nightmare did I ever think that it would be my own government that I would have to protect my children from,” Lundeby said. “This is the United States, and I feel like I live in a third world country now.”

A federal judge has issued a gag order on the case.

wish we would have been wrong

all i can say is i am glad i am closer to dieing than being born

it is the children of today who's tomorrows i worry about what kind of liberties will they have

All this tells me is that it doesn't matter what party or ideology is running the government. When they get power like this they will use it.

This kid was arrested in March. That is Obamas justice department. They run the FBI. Sorry..

if the kid did indeed make the nomb threat then he is screwed and justifiably

if he didn't and someone hacked his IP (doubtful) then it would show up on his computet

ADJ... This is a chance for an American citizen other than Jose Padilla to challenge this at the Supreme Court. This is a violation of the equal protection clause. This might be the only way to rid ourselves of this. Piece by piece..

IP theft is quit common and has become a recent amusement of hackers. This seems a lot like those instances. The hacker will steal your IP then make internet calls from his computer using your IP, so it looks as if you are the one making the calls. There have been a few cases where someone did this, called 911 in the middle of the night and claimed that someone in the house had a gun and was threatening to kill everyone in the house. Obviously, moments later armed law enforcement agents are breaking down the door guns drawn. That's a hell of a way to woken up.

I don't think they arrested him under the Patriot Act just for the fun of it. There is prolly something there

and no one else can look at it

or even talk about it

nor have an opportunity to verify or disprove whatever they say

that is the issue

not whether the kid actually did it

but that he has none of his constitutional rights to show that he did not do it

the govt can do anything they want to him and there is no recourse

there will more than likely be something incriminating on his computer before anyone else gets to see it

Saying just because he was arrested there is " prolly something there" is scary. I wouldn't want you on a jury that's for sure.

Innocent people are routinely arrested, some jailed and some even put to death.

What about due process, the writ hebeas corpus ohh heck let's throw in the assumption of innocence.
