ok here is the situation. Cps worker shows up at door. Obviously I
dont want him in cause I am in process of changing the house around and what not after two waterline breaks. He says "you dont have to let me in but I will sit here, call police.... take kids away right now." how much of this is the truth? andhow much of it is bluff? First of all, to my knowledge cps and police still need a warrant to enter without my permission (without obvious reasons apparent from without, which they did nto have. It was literall, him standign in front of porch, me in doorway talking through window. He telle me let him in or he calls police and they take the children away now. No warrant no nothing. He also telles me that if someone intentionally slanders me again, waiting for a day like otday when house is being moved around, even if it is obvious things are being moved around, he will take the kids period. Can anyone help? |

If I were you Id call the police on them the next time they show up at
your door. Tell the police they are harrassing you. Get the house in order-MI is nasty when it comes to this sort of thing.Good luck! |

U need to move if things dont change. Depending upon how bad dictates
how far. Get a po box. Consult numerous lawyers. |

when a cps angency gets a call, it is put on national records. This is one of the background checks done forcertain jobs, especially those involving kids. I happento agree withthe idea too, but for me it can be a pin. |

My first thought, is why is CPS showing up at your door?

what is happening pucks is I have two neighbors who both believe you
shuld let your children do whatever they want whenever they want with no discipline, they have outright stated this to me, and not in a joking manner as I damn near had to call the cops for the one neighbor, who tried to get in between me and my son when my son went around the block by himself (he is 6 years old). I yelled for my son, told him to get his happy little butt back in the yard and to put his bike away ashe was now grounded from it, and the neighbor decided I was being abusive. Yes someone called, claimed i was being abusive, beating, swearing, belittling you name it. They made sure to call when it was widely known that I was cleaning up my kitachen from a waterline break (2 of them actually) and the house would be a mess and claimed the house was dirty and unfit. Well duh yes the house WAS dirty from me moving stuff around to clean up the original mess. |

first ask why are they there and reasons for being there. hire a lawyer.
if the police dont have a warrant tell them to screw themselves. |

I went ahead and let him in as far as my entryway today, and that was
it. Tomorrow, wether he has a warrant or not I will be waiting with my old school tape recorder (designed to record speaches from up to thirty feet away ). I am going to lead the coversation back through everythig said today and get him to repeat it while on tape, and then I am going to give a copy of said tape to the da. And then we take it step by step from there. Needless to say I am sick and tired of the bull**** of having to deal with cps every month simply cause the lady next door is offended because I haev custody of my kids and my ex doesnt. Oh, speaking of which she came out and verified it for me today that she is the one that called. If not, then she was definitely involved with the call cause she knew about it taking place and what it was that was reported. |

not sure about your state, daniel...but here, they can come in if they
choose, and they can take your kids if you don't let them in. they have MUCH more lee-way than law enforcement...all she/he would have to do is call a judge and they would get an immediate order for temporary custody to the state. |

thats just it hun, no matter what state your in (and I am sure that what
you said actually does happen, bit it doesnt mean it is legal), the cps worker can NOT enter the house without your permission unless they have a signed warrant and are accompanied by a police officer (the officer is who willa ctually remove the child from the home). |

thanks hun, but I am in ichigan so he can not legally say anything other
than to contact a michigan lawyer I dont want you to sk him to do something he would havt to telly ou no on or get in trouble for doing. But I appreciate the offer anyway. |

daniel..... cps is exactly for people like you...hope they keep a
strong eye on ya!! why does this story not surprise me??? and all your veteran injuries and poor me attitude sitting behind the computer, and 'i deserve more' because i killed for my great country.... and you prolly do abuse your children and are fanatically one of those spare the rod spoil the child parents...and most likely think you can still justify it here.... i don't feel sorry for you , and you do need help , but the cps hopefully will see to it and your good neighbors... ugh |

I don't know enough about you to say one way or another. I do know I had my own battles to fight, and just f*cking did it, and won. You ask about this, and it seems the guy knows you, so there must be questions, yes? Regardless of my own nightmare... they services are there to protect the kids. And, I know of many filthy houses whom kids run around all the time, and noone takes the kids away... Would the person NOT know the place would be a mess after what you claim? So what! Let them in. Looks worse by refusing to cooperate. I'm surprised with the neighbors you have that you haven't taken them to court... since anyone can sue for any damned thing now... |

daniel48706 in many states it is illegal to tape a convo with out all
parties knowing about it, to cover your ass, put up a sign in the entry way of your home saying that there is a chance ppl entering your home may be video tapped or voice recorded... other wise it may be no good to you, your not in court no one has been sworn in, and it is not illegal to lie... So the worker can lie all theyt want make any promices they want, and nver keep them |

here shugar. NO you dont have to let cps inside unless they have a warrant. BUT its best to let them in. You have a right to ask what the allegations ARE prior to opening that door for entry. Do i know about cps. BIG SIGH! YOU BET I DO! Had them at my door a few years ago. And another time when a neighbor was mad at me. I got on the phone as soon as they banged on my door. My lawyer said LET THEM IN AND COOPERATE. I did. The hassles AND UNWARRANTED BOGUS ALLEGATIONS were proven. Sadly its good parents that get hassled and the ones who really NEED PROTECTION? HA HA HA!! Thats a JOKE! It IS LEGAL to record the conversations and i suggest you do so if the CPS worker is making THREATS. GREAT AMMO FOR COURT. ITS DOCUMENTED EVIDENCE. |
