Ex-officer is charged with sexual abuse of girl
Brian Livingston, 40, recently resigned from his job in Turner By Ruth Liao • Statesman Journal January 31, 2009 A former Turner reserve police officer has been charged with sexually abusing a girl and was booked into jail Friday. Brian Livingston, 40, was arraigned Friday morning in the Marion County Circuit Court annex on charges of second-degree unlawful sexual penetration, three counts of first-degree sex abuse and one count of first-degree official misconduct. Livingston was indicted by a grand jury Jan. 20, according to court documents. The reported abuse was of a girl younger than 14 and spanned five years, according to the indictment. Referee judge Gale Rieder set bail at $100,000, following a recommendation from the Marion County District Attorney's Office. Attorney Jeffery Jones asked the court to consider lowering the bail to $50,000 because of Livingston's clean history and his experience in law enforcement. Jones said Livingston grew up in the Salem area and graduated from McKay High School in 1986. Livingston studied at Chemeketa Community College while working to get an associate's degree in criminal justice. Jones also pointed out that Livingston cooperated with the investigation conducted by Oregon State Police by complying with detectives and submitting to a polygraph test. Jones said his client had no contact with the girl, whose father used to be Livingston's roommate. Rieder said she appreciated Livingston's cooperation but preferred to follow the prosecutor's recommendation. Livingston was unable to post bail and was taken into custody after his arraignment. Livingston resigned from his job as a Turner reserve police officer Monday, Turner Police Chief Gary Will said. None of the sexual-abuse allegations involved Livingston while he was at work, Will said. Livingston had been on administrative leave since the allegations were reported in August, Will said. The Turner Police Department has three full-time officers and six reserve officers. Livingston was assigned to general patrol duties as a reserve officer. The Turner department cooperated with the Oregon State Police investigation and the district attorney's office, Will said. Livingston resigned before an internal investigation could be completed, Will said. Livingston also worked as a corrections officer when he was hired on a temporary basis under the Marion County Corrections Department, said Lt. Sheila Lorance, a sheriff's spokeswoman. Livingston was employed by the county from February 1990 to January 1993. |
