you can if she violated that vicarious liability clause in the laws and guide lines set down state to state.if you can prove she acted out of the scope of her duty as an officer. if she didnt,you can always just sue the town or city. you probably should just sue the city or town where employed and her, "personally" for any wrongful actions against you. consult an attorney and be mindfull of retrobution!:wink:

im sorry peccy,flowerforyou yes you can sue the cop, the city, and the police station, for every and all damages done to you, physically and emotionaly, and to your vehicle. Same thing happend to my sister, she won.

The city should not be hiring incompetent drivers. Male or female does not matter. That one did not belong behind the wheel of a police cruiser. Might be different if she was in a high speed chase. Peccy needs to be compensated for everything lost, plus pain and suffering.

Consult with an attorney or two. Plenty of them out there especially for personal injury and consultation is usually free ('cause they want their money when you get your money laugh )

Probably, especially if you could prove incompetence or if she was under the influence. There are likely limitations in your area, but you might even be able to sue the city too. Ask rodney king. Be grateful however if they replace your vehicle and pay for your hospital bills though. It's often perplexing how government officials can tend to get away with even murder. If she admitted it was her fault officially, you'll be taken care of, most likely. You can in fact sue anyone for any reason, or no reason what-so-ever. Once, it cost me more than $30,000 to not settle for $9000.00, and had I started out right, I would have gone direct to Morris and Stone in Orange County, california and they would have kicked it right out of court using the communications decency act. The fact is, however, the precident it set even protects the admins of this site against frivilous lawsuits, so it worked out for the best.

For future reference, if the admins are listening, the moment someone threatens a lawsuit based on the actions of the users of this "interactive computer service", tell him to file a motion for dismissal based on the Communications Decency act, and if you have further questions, feel free to contact me.
